Terms of Use

These Terms of Use ("Terms") are an agreement between you and Lil Friends, LLC ("we," "us," "our") covering the lil friends mobile app and the website at https://lilfriends.app (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Summary
- You own the photos you upload and the portraits generated for you. We take only the license needed to run the Service, including review of portraits you flag with the feedback button.
- Do not upload photos of people without their permission or attempt to create harmful or illegal content. Custom prompts are screened automatically.
- Portraits are AI-generated. Results vary, are not guaranteed to be accurate or unique, and similar portraits may be generated for other users.
- Paid features use credits and subscriptions, billed through Apple or Google. Deleting the app or your account does not cancel a subscription; cancel it in your app-store settings.
- We may suspend accounts that violate these Terms.
1. Eligibility
You must be at least 13 years old. If you are under the age of majority where you live, you may use the Service only with a parent or guardian's consent, and they agree to these Terms on your behalf. By using the Service you confirm you meet these requirements and are not barred from using it under applicable law.
2. Your account
The app creates a guest account automatically on first launch. You can link an Apple or Google account to keep your creations across devices and reinstalls; you are responsible for the security of that account. A guest account lives on one device — if you uninstall without linking, its content cannot be recovered.
You can delete your account at any time from the Account screen while signed in. Deletion is permanent and includes your portraits and remaining credits. It does not cancel a subscription (Section 7.6).
3. Your content and licenses
"Your Content" means the photos you upload, the custom scene text you write, and your pet profile details.
3.1 Ownership
Your Content is yours. These Terms do not transfer ownership of it to us.
3.2 License to us
You grant Lil Friends, LLC a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, adapt (for example, resizing and re-encoding), and display Your Content, and to share it with the service providers that operate the Service (such as our cloud host and AI provider), in each case only to:
- (a) operate and provide the Service, including generating portraits from your photos;
- (b) run automated safety moderation and prevent fraud and abuse;
- (c) allow authorized employees of Lil Friends, LLC to review content associated with a portrait you flagged with the feedback button — the generated portrait, the photo it was made from, and its prompt — together, through internal tools, for quality assurance and to improve our scenes, prompts, and generation pipeline; and
- (d) comply with law.
This license is sublicensable only to those service providers and transferable only as part of Section 13.4. It ends when you delete the relevant content or your account, except for temporary residual copies in backups and logs and records we must keep by law. We will not use Your Content or your portraits to train AI models, and we do not publish your photos or portraits.
3.3 Your responsibilities
You confirm that you own Your Content or have permission to use it; that any person recognizable in a photo you upload has consented; and that Your Content does not violate law or anyone's rights, including privacy, publicity, and intellectual-property rights. You are responsible for Your Content and for your use of your portraits.
3.4 Generated portraits ("Outputs")
As between you and us, you own the portraits generated for you, and we assign to you any rights we may hold in them. Access to the full-resolution, watermark-free version of a locked portrait requires unlocking it (Section 7). The license in Section 3.2 applies to Outputs as it does to Your Content.
3.5 Suggestions
If you send us ideas or suggestions about the Service (separate from the in-app feedback button, covered by Section 3.2(c)), we may use them without restriction or payment.
4. Acceptable use
Do not use the Service to upload, request, or attempt to generate content that:
- is illegal or promotes illegal activity;
- sexualizes, exploits, or endangers a minor in any way;
- is sexually explicit, or depicts a real person in intimate imagery without consent;
- harasses, threatens, or defames anyone, or promotes hatred or violence against any person or group;
- depicts or promotes cruelty to animals;
- infringes copyright, trademark, privacy, or publicity rights;
- impersonates a person or misrepresents the origin of content; or
- includes another person's photo without their permission.
Also do not:
- bypass or attempt to bypass prompt moderation, credit limits, unlock gating, or the one-per-person rules for the free portrait and referral rewards, including by creating multiple accounts or manipulating device identifiers;
- probe, scrape, overload, disrupt, or reverse engineer the Service, except where the law grants that right;
- resell or commercially redistribute the Service itself. This does not restrict your use of your own portraits, including commercial use.
Custom scene text is screened by an automated moderation system before generation and rejected if it violates safety rules. Repeated attempts to submit violating prompts may lead to suspension.
5. Review and enforcement
We may, but are not obligated to, review content where these Terms or the law give us reason to — most commonly portraits you flag with the feedback button, as described in Section 3.2(c) and the Privacy Policy. We may remove content, withhold or revoke fraudulently obtained credits or rewards, and suspend or terminate accounts we reasonably believe violate these Terms, create risk for us or others, or are engaged in fraud or abuse. Where practical and lawful, we will state the reason. We maintain anti-fraud records (a hashed sign-in identity and a device ledger), including after account deletion, to enforce one-per-person limits.
6. AI disclaimers
Portraits are produced by a machine-learning model operated by a third-party provider. Accordingly:
- Results vary. A portrait may be inaccurate or distorted and may not faithfully represent your pet.
- Outputs are not unique. The model and preset scenes are shared by all users, and portraits generated for others may be similar to yours. We make no promise of uniqueness or exclusivity of any output, style, or scene.
- Portraits are for personal enjoyment and are not advice or a factual depiction of anything.
- Generation depends on third-party infrastructure; speed and availability are not guaranteed. If a generation fails, the credit it reserved is automatically returned.
7. Credits, subscriptions, and payment
7.1 Free first portrait
New users receive one free portrait generation (basic scene). The result is locked and shown with a watermark until unlocked with a credit or subscription. The free portrait is limited to one per person, enforced per account, per device, and per Apple/Google identity, including after account deletion.
7.2 Credits
One credit provides one portrait generation (producing an unlocked portrait) or one unlock of a locked portrait. There are three kinds:

Credits are spent in that order (subscription, then pack, then referral). Premium scenes (every scene except the basic one) and custom prompts require a subscription or pack credit.
7.3 Subscriptions
Plans, prices, and billing periods are shown in the app at purchase and renew automatically until canceled. Subscribing also unlocks any locked portraits on your account. Manage or cancel in your App Store or Google Play settings; cancellation takes effect at the end of the current billing period, and access continues until then.
7.4 Billing
Payment is processed by Apple or Google through your store account; we do not receive or store card details. Prices are shown before purchase and may include store-applied taxes. We may change prices or included features prospectively; changes to an existing subscription price follow the store's notice and consent rules.
7.5 Refunds
Purchases are refundable only as required by law or under the store's refund policies. Refund requests go to Apple or Google, and we do not control their decisions. Where you have a statutory withdrawal right for digital content, you consent to immediate delivery and acknowledge losing that right once generation or access begins, to the extent your law allows. Credits and rewards have no cash value and are non-transferable.
7.6 Effect of deletion
Deleting the app or your account does not cancel a subscription; subscriptions must be canceled through the store. Credits remaining at account deletion are forfeited.
7.7 Referral program
You may share your referral code. When a friend redeems it, they receive one credit; when they complete their first portrait, you receive one. Redemption is limited to one per person and per device, and self-referrals (including from the same device) do not count. We may deny, revoke, or recover rewards we reasonably believe were obtained through fraud or abuse, and may change or end the program at any time. Credits already earned remain subject to these Terms.
8. Our intellectual property
The Service — including the app, website, design, artwork, scene catalog, software, and the lil friends name and logo — belongs to Lil Friends, LLC or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on any Apple-branded or Android devices that you own or control, for personal use, as permitted by the applicable app store's Usage Rules. This section does not limit your rights in Your Content or your portraits.
To report claimed copyright infringement, email hello@lilfriends.app identifying the work, the material at issue, and your contact information.
9. App store terms
The app is distributed through Apple's App Store and Google Play, whose terms also apply. Apple and Google are not parties to these Terms, are not responsible for the Service, and have no support obligations. For iOS: these Terms are between you and Lil Friends, LLC only; Apple's only warranty obligation, if any, is to refund the purchase price; Apple is not responsible for claims relating to the app, including product liability, regulatory compliance, consumer protection, and intellectual-property claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms, entitled to enforce them against you. You confirm you are not located in a country subject to a US government embargo and are not on any US restricted-parties list.
10. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, error-free, or secure, that defects will be fixed, or that any portrait will meet your expectations (Section 6). Nothing in these Terms limits consumer rights that cannot be waived under the law of your jurisdiction.
11. Limitation of liability
To the fullest extent the law allows: (a) we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill; and (b) our total liability for all claims relating to the Service is capped at the greater of US $50 and the amount you paid us in the 12 months before the event giving rise to the claim. These limits apply under any legal theory, even if we were advised such damages were possible. They do not apply to liability that cannot be limited by law, and nothing here limits liability for willful misconduct or excludes non-waivable consumer rights.
12. Indemnification
Except where prohibited for consumers under local law, you will defend and hold harmless Lil Friends, LLC and its officers, employees, and agents from third-party claims, including reasonable attorneys' fees, arising from Your Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.
13. Termination and general terms
13.1 Termination
You may stop using the Service or delete your account at any time. We may suspend or terminate access as described in Section 5, or discontinue the Service with reasonable notice where practicable. On termination, your license to use the app ends. Sections 3.4 (your ownership of Outputs), 10–12, and 14 survive.
13.2 Changes to the Service
We may add, change, or remove features. We are not liable for modifications or discontinuation except where the law provides otherwise.
13.3 Changes to these Terms
We may update these Terms. For material changes, we will give notice in the app or by other reasonable means before they take effect. Continued use after the effective date constitutes acceptance; if you do not agree, stop using the Service and cancel any subscription.
13.4 Assignment
You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
13.5 Entire agreement; severability; waiver; third parties
These Terms and the Privacy Policy are the entire agreement regarding the Service. If a provision is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver. These Terms create no third-party rights except for Apple as described in Section 9.
14. Governing law and disputes
Before filing a claim, contact hello@lilfriends.app with a description of the dispute; both sides will attempt in good faith to resolve it within 30 days.
These Terms are governed by the laws of the State of Texas, excluding its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Travis County, Texas, and both sides consent to their jurisdiction. You may bring qualifying claims in your local small-claims court. If you are a consumer whose home country's law gives you mandatory rights to sue, or be sued, there or under that law, those rights are unaffected.
To the extent your law allows, claims may be brought only individually, and not as a plaintiff or class member in a class, collective, or representative action.
